Washington, D.C. – Yesterday, the Board of Immigration Appeals (BIA) issued a major decision targeting DACA recipients and other individuals who travel abroad through advance parole. Advance Parole is a travel authorization issued by U.S. Citizenship and Immigration Services (USCIS) that allows DACA recipients to leave the U.S. temporarily and lawfully return without losing their DACA status or work authorization.
In its decision, the BIA ruled that leaving the country under Advance Parole would now be constituted as a departure from the U.S. and potentially subject individuals to a 10 year bar from adjusting their status. The ruling on the Matter of Delcarmen-Lara is the latest in a pattern of attacks aimed at dismantling DACA’s protections by a thousand cuts.

“The BIA decision is the latest example of an administration determined to gut DACA through a thousand cuts. From mounting renewal delays that are pushing people out of status and out of work, to the growing detention and deportations of DACA recipients and immigrant youth, and now this latest ruling, Congress cannot look the other way while this administration dismantles DACA behind the scenes.
This decision only underscores the urgent need for Congress to act now and sign onto the Dream & Promise Act discharge petition immediately upon returning to D.C. at the end of this month. Of the 218 signatures needed to force the Dream & Promise Act to the House floor for a vote, only 8 more are needed. Congress cannot continue to denounce this administration’s actions in one breath, while refusing to actually use the power it has to put a stop to these attacks in another. Only citizenship can provide the permanence, stability, and dignity that communities deserve and that the majority of Americans already support.”
