The Top 5 Things You Should Know about DACA Being Restored

A judge in New York has ruled once again in favor of DACA recipients! Trump has been using the courts to end the program as we know it, but today a judge has ordered the government to return DACA to its original form. Here’s what you need to know:

1) DACA IS BACK!

The order instructs the government to revert the DACA program back to its original form before the September 5, 2017 rescission memo!

But what does this REALLY mean? 

  • If you have never had DACA and are eligible, you can apply for the first time.
  • Advance Parole is back in its original form
  • Anyone who received a 1-year renewal of their DACA will automatically have their protections extended to two years 
  • DACA renewals for those who have DACA or have ever had DACA remain open

3) When does this happen?

The judge’s order is immediate. We recommend you consult a lawyer or trusted legal representative, so you can make the choice to apply for DACA for the first time or Advance Parole.

This order is a victory, but we expect the Trump Administration to respond soon. We encourage you to consider applying for the first time or for advance parole if you can as soon as possible.

5) DACA is still under threat.

Not only will Trump respond to this decision, on December 22 a Texas court, led by Judge Hanen, will hear a case on the legality of DACA.
